By law they have to have all 1099's postmarked by Jan 31st. Your recourse if they were not , I do not know. I do know that you do not have to have a 1099 to file your taxes, you just enter the amount that you recieved in the appropriate box. So good luck going back on them. Real question is who much is that added winnigs going to effect the outcome of your taxes, and are willing to risk getting caught in an audit if you do not refile.
