Rules and regulations can be, if they are developed in house and protected.
The difference in the NFL, MLB, and other 'sports' is that those rules were developed and not protected and became 'open source' for lack of a better term. KCBS sells a service with a package, and that IS proprietary and can be defended based on opinion(s) I've been given. Eventually, I suspect it will be sorted out in court. KCBS needs to retain IP counsel yesterday, in my opinion.
That doesn't mean that licensing should be off the table, but it does mean that it deserves more serious attention and a reasonable policy that is consistent since the issue is coming up more frequently.
