This excerpt is from an article about not allowing the sell of previousley frozen turkeys as fresh....
"Under current regulations, poultry frozen to an internal temperature of 1 degree Fahrenheit can be sold as fresh. The new rule will prohibit poultry from being called fresh if it has been chilled below 26 degrees, the temperature at which poultry becomes hard to the touch."
So what it appears in this Gov. article is Turkey is not considered frozen until 26 degrees. So indeed, it would appear your bird would not freeze in a 28 degree brine.
