You said "It isn't illegal to own a still" I think you may find that may vary from state to state. Think Virginia. "§ 4.1-314. Keeping, possessing or storing still or distilling apparatus without a permit; penalty.
No person shall keep, store or have in his possession any still, or distilling apparatus, without a permit from the Board."
In Virginia law it also mentions the "presence of mash". The main ingredient that differentiates wort for making beer from mash for making whisky is hops. So if your making beer in Virginia I guess you have to put the hops in the pot first.
Some states also do not allow home brewing. Think Utah and Alabama.
